NTEU Wins FLRA Ruling Over Bargaining Unit Status Of NCUA Employees

Washington, D.C.— National Treasury Employees Union (NTEU) President Colleen M. Kelley said today that she was “pleased but not surprised” by a decision that will finally allow employees of the National Credit Union Administration (NCUA) to vote on bringing NTEU representation to NCUA employees.

The decision by the Federal Labor Relations Authority (FLRA)—a three-member body that oversees federal sector labor-management relations—upholds an earlier decision that nearly 500 NCUA field examiners are eligible to be represented by NTEU.

“The decision by the FLRA puts an end to attempts by the NCUA to deny agency employees their right to vote on union representation,” Kelley said.

NCUA repeatedly had challenged the bargaining unit eligibility of some 500 agency employees, mostly credit union examiners. Including those employees whose eligibility was not challenged, some 800 NCUA professional and non-professional employees will be eligible to vote in a representation election.

“NCUA’s consistent claims that these front-line employees were management officials did not ring true for NTEU or for the FLRA,” Kelley said. NTEU is looking forward to the representation election that will allow NCUA employees nationwide to benefit from NTEU representation, Kelley added. An election, which will be administered by the FLRA, will likely take place this summer.

NCUA administers the Federal Credit Union Act, which gives it the authority to supervise and regulate federally-insured credit unions, as well as some state-chartered credit unions. Its principal task is to ensure credit union safety and soundness and to minimize risk to the National Credit Union Shared Insurance Fund. That fund covers the liabilities of an individual credit union that might be closed and liquidated, ensuring that depositors receive all their insured funds.

Organizing NCUA employees would be another step in NTEU’s growing representation of financial regulatory agencies. The union already represents employees of the Federal Deposit Insurance Corporation, Office of the Comptroller of the Currency and Securities and Exchange Commission.

As the largest independent federal union, NTEU represents some 150,000 employees in 29 agencies and departments.
