Statement of NTEU President Colleen M. Kelley On Action of DHS Concerning Court Decision

The decision by the Department of Homeland Security (DHS) to ask Judge Rosemary Collyer to narrow the court’s injunction preventing DHS from implementing its illegal personnel rules is disappointing. NTEU believes that all aspects of the personnel system challenged in the case are inextricably intertwined with one another and that unless the entire system is overhauled to ensure collective bargaining as Congress required, DHS cannot lawfully move forward. As a result, NTEU will vigorously oppose the DHS request to narrow the court’s injunction. To emphasize a point I made in a meeting with DHS Deputy Secretary Michael Jackson last week, the entire DHS personnel system is in need of a fresh look. NTEU remains willing to work with DHS to create a personnel system that accomplishes the department’s mission while respecting the rights of front-line workers. It was clear from Judge Collyer’s decision on Aug. 12 that the system advanced by DHS failed to do that.
